Community Rules and Acceptable Use Policy

1. Purpose and Scope

1.1. Purpose

These Community Rules and Acceptable Use Policy (the "Rules") set out the rules concerning the conduct that Users and Organisers may display, and the content they may create, upload or share, on the Gathin platform ("Gathin" or the "Platform") operated by Loopcode Bilişim Yazılım Mühendislik Eğitim ve Danışmanlık A.Ş. ("Loopcode" or the "Company"). The purpose of the Rules is to maintain the Platform as a safe, lawful and respectful community environment.

1.2. Scope

These Rules cover all user content created, shared or transmitted on the Platform ("User Content" or "Content"), including in particular community photo galleries (including photo uploading, liking and tagging other users), forum messages, organiser announcements, forms, event and community descriptions and user profiles, as well as events organised through the Platform ("Event") and all usage conduct.

1.3. Acceptance and Binding Effect

By accessing the Platform, creating an account or using the Platform in any way, you declare that you have read and understood these Rules and agree to comply with them. These Rules form an integral part of the Terms of Use and are to be read together with the Privacy Policy and the KVKK Privacy Notice. The sales relationship relating to paid ticketed Events is additionally subject to the Distance Sales Agreement and the Cancellation and Refund Terms.

1.4. Minimum Age

The Platform is not intended for use by persons who have not completed the age of sixteen (16). Any person using the Platform declares that they have completed the age of sixteen (16). The Company reserves the right to suspend or close the accounts of users it determines to be under the age of sixteen.

1.5. Definition of Roles

The User or Organiser who creates, uploads or organises User Content and Events is exclusively responsible for it. In respect of User Content, Loopcode is in the position of a hosting provider within the meaning of Law No. 5651 on the Regulation of Publications on the Internet and Combating Crimes Committed by Means of Such Publications, and has no obligation to review Content before publication. For paid tickets, Loopcode's capacity as merchant of record does not transfer the content and conduct responsibility set out in these Rules from the User and Organiser to the Company.

2. Prohibited Content

Users and Organisers may not create, upload, publish, share, transmit or make accessible Content of the nature listed below on the Platform. This list is illustrative and not exhaustive.

2.1. Unlawful Content

Any Content that is contrary to the legislation in force, to Turkish Criminal Code No. 5237 and to other laws; that constitutes a crime, incites crime, praises crime or facilitates the commission of a crime is prohibited. Content that praises, legitimises or propagandises terrorist organisations, acts of terrorism or violent unlawful structures is strictly prohibited.

2.2. Hate Speech

Content that degrades a person or group on the basis of language, race, colour, gender, political opinion, philosophical belief, religion, sect, ethnic origin, sexual orientation, age, disability or similar characteristics, that incites hostility or hatred, or that promotes discrimination is prohibited.

2.3. Harassment and Bullying

Harassment targeting a person, systematic pestering, intimidation, threats, blackmail, stalking, calls for coordinated attacks and any form of online bullying conduct are prohibited. Content in the nature of insult or abuse targeting another person's honour, reputation or personal rights falls within this scope.

2.4. Violence

Content that praises, encourages, organises or celebrates violence against real persons or animals; that contains images of serious injury, torture or death; or that directs persons towards physical harm is prohibited. Content encouraging self-harm or suicide is likewise prohibited within this scope.

2.5. Obscenity and Sexual Content

Obscene Content, pornographic material and sexual exhibitionism are prohibited. Any Content relating to the sexual abuse of children is absolutely prohibited and, where detected, is removed immediately and reported to the competent authorities as prescribed by the legislation.

2.6. Spam and Unsolicited Messages

Misleading, repetitive or bulk-sent unsolicited commercial or non-commercial messages; masses of automatically generated content; phishing links, malware, viruses or Content containing similar malicious code are prohibited. Abuse of the Platform's messaging and announcement mechanisms for sending commercial electronic messages constitutes a breach of the obligations under Law No. 6563 on the Regulation of Electronic Commerce, the Regulation on Commercial Communication and Commercial Electronic Messages and the Message Management System (İYS), and is prohibited.

2.7. Misleading Content

Untrue, deceptive or misleading statements; fake event, fake ticket or fake campaign information; impersonation of another person; Content for the purpose of fraud and any deceitful statement intended to cause users material or moral harm are prohibited.

2.8. Copyright and Intellectual Property Infringement

Using, reproducing, distributing or communicating to the public any works, trade marks, designs, logos or other content protected under Law No. 5846 on Intellectual and Artistic Works and other intellectual and industrial property legislation, without the permission of the rights holder, is prohibited. The User undertakes that they hold all necessary rights and permissions in respect of the Content they upload or share.

2.9. Sharing Another Person's Personal Data Without Consent

Sharing another person's personal data on the Platform without a valid legal ground or explicit consent under Law No. 6698 on the Protection of Personal Data (the "KVKK") is prohibited. The disclosure without consent (doxxing) of data belonging to third parties, including a person's name, contact details, address, identity information or special categories of personal data, is strictly prohibited.

2.10. Photo Tagging Without Consent

Tagging other users or third parties in community photo galleries without their consent, or tagging in a manner that would disturb the person, violate their privacy or present them in a misleading context, is prohibited. A tagged person may at any time request the removal of a tag relating to them; such a request is met without delay.

3. Prohibited Events

Organisers may not create or publish Events of the following nature on the Platform, or open tickets or RSVP registration for them. This list is illustrative.

3.1. Unlawful Events

Events that are contrary to the legislation in force; that constitute or incite a crime; or for which the necessary official permits, licences or notifications have not been obtained are prohibited. Where the legislation requires a permit, licence or notification for the staging of an Event, obtaining these is exclusively the responsibility of the Organiser.

3.2. Deceptive or Fraudulent Events

Fake Events that are not in fact planned to take place and are created in order to mislead attendees or obtain unjust gain; and Events in the nature of unlawful lotteries, gambling or pyramid schemes are prohibited.

3.3. Events Containing Content Covered by Section 2

Events that concern, encourage or facilitate the dissemination of the types of content prohibited in section 2 of these Rules are prohibited.

3.4. Events Endangering Safety or Public Order

Events that endanger the safety of attendees' lives and property, that disrupt public health or public order, or that are intended to organise violence or hatred are prohibited.

3.5. Sale of Prohibited Goods and Services

The promotion, sale or distribution within the scope of an Event of goods and services whose sale is prohibited by the legislation or subject to special permission (narcotic and psychotropic substances, firearms and the like) is prohibited.

4. User Content and Responsibility

4.1. Responsibility for Content

The User or Organiser who creates, uploads, shares or organises User Content and Events is exclusively responsible for it. The User undertakes that the Content they create or share complies with these Rules, the legislation in force and third-party rights, and that they hold all necessary rights, permissions and consents in respect of the Content.

4.2. The Company's Position and Review

Loopcode is not obliged to systematically monitor or review User Content before publication. However, the Company reserves the right to examine Content that it determines, or that is reported to it, as being contrary to these Rules or the legislation, and to apply the sanctions provided for in section 6. The Company's exercise of this right does not create any obligation or undertaking to review the lawfulness of Content.

4.3. Right of Use (Licence)

In respect of Content uploaded to or shared on the Platform, the User grants Loopcode a limited, worldwide, royalty-free right of use for the purposes of hosting, displaying and technically processing the Content on the Platform and reproducing it to a reasonable extent for the provision of the Platform. This right is limited to the purpose of presenting the Content on the Platform, and the User's ownership and intellectual rights in the Content remain with the User.

4.4. Processing of Personal Data

Personal data practices relating to the processing of User Content are carried out within the scope of the Privacy Policy and the KVKK Privacy Notice. Organisers are themselves responsible for complying with their obligations arising from the KVKK in respect of attendee data obtained within the scope of their own community and event management.

5. Notification and Complaint Mechanism

5.1. Notification Channel

If you encounter Content, an Event or conduct that you believe to be contrary to these Rules, you may report it to the Company via info@loopcode.co. The reporting tools provided within the Platform for the relevant Content or Event may also be used for this purpose.

5.2. Content of the Notification

So that your notification can be assessed without delay, we recommend that you provide identifying information relating to the Content or Event complained of (link, screenshot or location information), an explanation of the nature of the breach and, if any, information showing that you are the rights holder or an interested party. In notifications relating to copyright infringement, you must state that you are the rights holder or are acting on behalf of the rights holder.

5.3. Assessment

The Company examines the notifications it receives within a reasonable period and takes the measures it deems appropriate within the framework of these Rules and the legislation. Applications relating to violations of personal rights or falling within the scope of Law No. 5651, together with requests from judicial and administrative authorities, are assessed as a priority. The Company may block access to Content that is clearly understood to be unlawful without waiting for the examination period.

6. Sanctions

6.1. Applicable Sanctions

Where a breach of these Rules is established, the Company may apply one or more of the following sanctions, taking into account the nature and gravity of the breach and whether it is repeated:

a) Blocking access to or removing the relevant Content or Event,

b) Issuing a warning to the User or Organiser,

c) Restricting access to certain features,

d) Temporarily suspending the account,

e) Permanently closing the account and terminating access to the Platform.

6.2. Proportionality

Sanctions are applied in proportion to the gravity of the breach. However, in cases such as the sexual abuse of children, terrorist propaganda, a serious security threat, or grave and repeated breaches, the Company may apply the sanction of suspending or closing the account directly, without prior warning.

6.3. Effect on Paid Tickets

Where an Event is removed on grounds of breach of these Rules or an Organiser account is closed, refunds and rights relating to valid tickets purchased by Buyers are assessed in accordance with the provisions of the Cancellation and Refund Terms and the Distance Sales Agreement. Consumer rights arising from Loopcode's capacity as merchant of record for paid tickets are reserved.

6.4. Reservation of Other Rights

The application of the sanctions provided for in this section does not eliminate the right of the Company or of third parties to claim compensation for damages suffered, to report the breach to the competent judicial or administrative authorities, and to exercise other rights arising from the legislation.

7. Appeal Process

7.1. Right of Appeal

A User or Organiser subject to a sanction of Content removal, account suspension or account closure may appeal against that decision.

7.2. Making an Appeal

Appeals are submitted to the Company via info@loopcode.co. In your appeal application, you are expected to provide information about the sanction applied to you, the grounds of your appeal and an explanation supporting your grounds, together with any documents.

7.3. Assessment of the Appeal

The Company examines the appeal within a reasonable period and notifies the applicant of the outcome. If, as a result of the examination, the sanction applied is found not to be justified, the Content is restored or the account restriction is lifted so far as possible. The final assessment of the appeal outcome is made by the Company within the framework of these Rules and the legislation.

7.4. Reservation of Legal Remedies

The appeal process set out in this section does not eliminate the User's or Organiser's right to apply to the courts. Disputes are governed by the laws of the Republic of Türkiye; the courts and enforcement offices of Istanbul have jurisdiction. In consumer transactions, the Consumer Arbitration Committees and the Consumer Courts have jurisdiction within the monetary limits announced.
