Cancellation and Refund Terms

1. General Principle

These Cancellation and Refund Terms govern the cancellation, postponement and refund processes relating to Event Tickets purchased through the Gathin platform (gathin.com). The platform is operated by Loopcode Bilişim Yazılım Mühendislik Eğitim ve Danışmanlık A.Ş. ("Loopcode" or the "Company").

Event Tickets relate to the provision of entertainment, cultural, artistic, educational and similar leisure services to be held on a specific date or during a specific period. Pursuant to Law No. 6502 on Consumer Protection and Article 15, first paragraph, subparagraph (g) of the Regulation on Distance Contracts, contracts relating to entertainment and leisure services that must be performed on a specific date or during a specific period are among the transactions in respect of which the consumer cannot exercise the right of withdrawal. For this reason, the Buyer has no fourteen-day statutory right of withdrawal in respect of Tickets for date-specific Events. This exception does not apply to online events or services that are not tied to a specific date (accessible on demand or without a time limit), and in those cases the Buyer has the fourteen-day right of withdrawal provided for in the Regulation.

The absence of a right of withdrawal does not eliminate the refund rights granted to the Buyer in cases of cancellation or postponement attributable to the Organiser, nor any voluntary refund options announced specifically for an Event. The conditions applicable to those cases are set out separately in the sections below.

This document applies together with the Distance Sales Agreement and forms an integral part of it. In the event of a conflict between these terms and the Distance Sales Agreement, the provision more favourable to the Buyer shall apply.

2. Seller Capacity and Conduct of the Refund Process

For paid Tickets, Loopcode acts in the capacity of merchant of record for the ticket. Loopcode sells the Ticket in its own name, collects the price from the Buyer and issues the document relating to the sale; it transfers the collected amount to the Organiser within the framework of the agreement between them. The Organiser is the party staging the Event and is not the seller of the Ticket.

Under this sales model, refund requests are received, assessed and concluded by Loopcode. The Buyer shall direct all applications concerning refund transactions to Loopcode through the channels specified in section 7 of this document, and not to the Organiser from whom the Ticket relates. Loopcode applies the refund decision within the framework of its agreement with the Organiser and the conditions announced specifically for the Event.

Payments are taken through the iyzico payment infrastructure with 3D Secure verification. Card details are transmitted to iyzico via Loopcode's payment infrastructure for the purpose of executing the payment and are not stored by Loopcode. Refunds are likewise carried out through the same infrastructure.

The currency in which payment was made (TL/TRY, USD or EUR) is taken as the basis. As a rule, the refund is made in the currency in which the payment was received and to the method by which the payment was made.

3. Cancellation and Postponement Attributable to the Organiser

3.1. Cancellation of the Event

If the Event is cancelled by the Organiser, the Buyer is entitled to request a refund of the full amount paid for the Ticket. In this case the refund is made over the full price, without any deduction.

Loopcode will notify the Buyer's registered e-mail address of the Event's cancellation within a reasonable period after that information reaches it, and will initiate the refund process. The Buyer is not required to submit a separate refund request; in the event of cancellation the refund process is carried out automatically.

3.2. Postponement of the Event or Material Change

If the date, time or venue of the Event is changed by the Organiser, the Buyer may either accept the new conditions and treat the Ticket as valid, or request a full refund of the price. If the Buyer does not communicate a preference within the period stated in the notification sent to them, the Ticket remains valid in respect of the new date and conditions.

The right to a full refund under this section also applies to material changes affecting the essential nature of the Event. Whether a change is material is assessed by reference to the type of Event and the Buyer's intention in making the purchase.

4. Refund Requests Attributable to the Buyer

For date-specific Event Tickets, as the Buyer has no right of withdrawal by reason of the legislation explained in section 1 of this document, tickets are as a rule non-refundable and a cancellation request made at the Buyer's own discretion does not give rise to a right to a refund.

For online events or services not tied to a specific date (accessible on demand or without a time limit), the Buyer may exercise the 14-day statutory right of withdrawal referred to in section 1; in that case the amount paid is refunded to the Buyer.

The Buyer does not pay any separate platform service or transaction fee in addition to the ticket price; the platform commission is deducted from the Organiser's entitlement out of the ticket price and is not passed on to the Buyer. Accordingly, the amount subject to refund is the ticket price paid by the Buyer.

The partial use of a Ticket, a duplicate purchase, or the Buyer's non-attendance at the Event does not in itself give rise to a right to a refund. Where a Ticket is found to be counterfeit, transferred without authorisation or misused, Loopcode reserves the right to cancel the Ticket concerned and, where necessary, to act without making a refund.

5. Refund Method and Timing

Approved refunds are, as a rule, made to the card used for payment and in the currency in which the payment was received. The refund is processed to the card by Loopcode through the iyzico infrastructure within 14 days at the latest.

The time taken for the refunded amount to appear in the Buyer's account may vary depending on the internal processes of banks and payment institutions. Once Loopcode has carried out the refund on its side, it cannot be held responsible for delays arising from banking systems.

The document relating to the sale subject to refund and the refund document are issued by Loopcode in accordance with the applicable legislation (e-Archive) and sent to the Buyer's e-mail address. In payments made in different currencies, differences arising from exchange rates and conversion fees applied by banks are not the responsibility of Loopcode.

6. Force Majeure

Natural disasters such as earthquake, flood and fire, epidemic disease, war, mobilisation, acts of terrorism, decisions of official authorities, general strikes, interruptions in electricity and communications infrastructure, and similar circumstances outside the reasonable control of the parties which prevent the performance of obligations are deemed force majeure.

If the Event is cancelled or postponed due to force majeure, the refund and postponement provisions in section 3 of this document apply by analogy. In the event of force majeure, the parties' liabilities arising directly from that situation are suspended for as long as the force majeure continues.

The principle that the amount is refunded through the iyzico infrastructure and to the method by which payment was received also applies to refunds made on grounds of force majeure.

Buyers who qualify as consumers may, in the event of a dispute, apply to the Consumer Arbitration Committees or the Consumer Courts within the monetary limits announced. For other disputes, the courts and enforcement offices of Istanbul shall have jurisdiction. These terms are governed by the laws of the Republic of Türkiye.
